Tostitos® Ultimate 2019 NFL Draft Official Rules

THE FOLLOWING PROMOTION IS INTENDED FOR PLAY IN THE CORPORATE LIMITS OF THE CITY OF NASHVILLE TENNESSEE ONLY. DO NOT ENTER THIS PROMOTION UNLESS YOU ARE ELIGIBLE AND A LEGAL RESIDENT OF THE NASHVILLE TENNESSEE AT THE TIME OF ENTRY.

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. BY ENTERING, ENTRANT AGREES TO BE BOUND BY THESE OFFICIAL RULES AND THE DECISIONS OF THE JUDGES (AS DEFINED BELOW), WHICH SHALL BE FINAL IN ALL RESPECTS.

ELIGIBILITY: Sweepstakes open only to legal residents of the City of Nashville Tennessee who reside within one of the zip codes designated in Appendix A and who are 18 years of age or older at time of entry. The following persons are not eligible to participate: Employees, contractors, directors and officers of Frito-Lay, Inc. (“Sponsor”), its parent, subsidiaries and affiliated companies, distributors, Web design, advertising, fulfillment, judging and promotion agencies involved in the administration, development, fulfillment and execution of this Sweepstakes (collectively, the “Promotion Parties”), NFL Entities (defined below) and immediate family members (spouse, parent, child, sibling, grandparent, and/or “step”) of each and those living in their same households (those persons whether related or not who live in the same residence for at least three months during the twelve-month period preceding the start date of the Sweepstakes).
SWEEPSTAKES TIMING: Sweepstakes begins on April 22, 2019 at 11:30 a.m. Central Time (“CT”) and ends on April 23, 2019 at 11:30 a.m. CT (the “Sweepstakes Period”).
TO ENTER:Visit the official TOSTITOS^® Facebook page located at http://www.facebook.com/Tostitos (the “Website”) and submit a list of your first three picks of the 2019 NFL Draft with #Entry in the comments section of Sponsor’s Tostitos Facebook page post on the Web Site. If you are not a registered member of Facebook, please visit http://www.facebook.com to register for a free account. NOTE: Any posts on an entrant’s personal Facebook page will not be counted as an Entry. All entries must be received and recorded during Sweepstakes Period. Sponsor's time clock is the official clock. Entrants must have a valid email address. All Entries must be received and recorded during the Sweepstakes Period. Hashtag (#Entry) must be included in your post for your entry to be considered valid. Limit one (1) entry per person/Facebook account. Entries will not be judged. Winners are selected via random drawing.
Entry Guidelines: As determined by the Sponsor, in its sole discretion, entries must meet the following guidelines: (a) Must comply with these Official Rules and any Terms of Service on the applicable Web Site; (b) Cannot be sexually explicit or suggestive, unnecessarily violent or derogatory of any ethnic, racial, gender, religious, political, professional or age group, profane or pornographic, or contain nudity; (c) Cannot promote alcohol, marijuana, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (d) Cannot be obscene or offensive, endorse any form of hate or hate group; (e) Cannot promote terrorist acts such as providing instructions on how to assemble bombs, grenades and other such weapons or provide instructional information about illegal activities; (f) Cannot defame, misrepresent or contain disparaging or slanderous remarks about Sponsor, its customers or its products, or other people, products or companies; (g) Cannot contain copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art, stills, or images published on or in television, movies, the Internet or other media, except such materials owned by Sponsor) without permission; (h) Cannot contain background artwork, unless it is an original work of the entrant; (i) Cannot contain materials embodying the names, likenesses, photographs, or other indicia identifying any person, living or dead, other than the entrant, without permission; (j) Cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor wishes to associate; and (k) Cannot depict, and cannot itself, be in violation of any law.
DRAWINGS: Five (5) finalists will be selected in a random drawing on April 23, 2019, immediately following close of the Sweepstakes Period from among all eligible entries received during the Sweepstakes Period by an independent judging organization (“Judges”) whose decisions are final in all matters relating to this Sweepstakes. After verification of eligibility and compliance with these Official Rules, one (1) Grand Prize winner, two (2) First Prize winners, and two (2) Second Prize winners will be selected in random drawings on April 23, 2019, from among all eligible finalist entries received by Judges. Odds of winning depend upon the number of eligible entries received.
PRIZE DETAILS: Grand Prize: One (1) Grand Prize winner will receive (a) two (2) tickets for winner and one (1) guest to the 2019 NFL VIP Draft area located at ACME Feed & Seed, including food and beverages; (b) transportation to and from the event location at 511 Union St. Nashville, TN, for winner and one (1) guest; and (c) a “meet & greet” with a former NFL player. Approximate Retail Value (“ARV”) $6,000. Winner’s guest must be at least twenty one (21) years old. First Prize: Two (2) winners will receive ten (10) bags of Tostitos brand chips (flavor/size to be determined at Sponsor’s sole discretion) ARV $42.90. Second Prize: Two (2) winners will receive one (1) bag of Tostitos brand chips (flavor/size to be determined at Sponsor’s sole discretion) and one jar of Tostitos brand salsa or dip ARV $8.08. Winners must accept prize as stated by Sponsor or prize will be forfeited and awarded to an alternate winner. Any difference between stated value and actual value will not be awarded. Total ARV of all prizes is $6,050.98. Limit one (1) prize per person/household.

Sponsor reserves the right to revoke full or partial prize from winner or winner’s guest who it and/or venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any venue policy or law, and/or may bring Sponsor into disrepute.

LIMITATIONS OF LIABILITY AND RELEASE:No liability or responsibility is assumed by Sponsor, Promotion Parties or NFL Entities resulting from entrant's participation in or attempt to participate in the Sweepstakes or ability or inability to upload or download any information in connection with the Sweepstakes. No responsibility or liability is assumed by the Sponsor, the Promotion Parties, or NFL Entities (as defined below) for technical problems or technical malfunction arising in connection with any of the following occurrences which may affect the operation of the Sweepstakes: Hardware or software errors; faulty computer, telephone, cable, satellite, network, electronic or Internet connectivity or other online or network communication problems; errors or limitations of any Internet providers, servers, hosts or other providers; garbled, jumbled or faulty data transmissions; failure of any online transmissions to be sent or received; lost, late, delayed or intercepted transmissions; inaccessibility of the Web Site in whole or in part for any reason; traffic congestion on the Internet or Web Site; unauthorized human or non-human intervention of the operation of the Sweepstakes, including without limitation, unauthorized tampering, hacking, theft, virus, bugs, or worms; or destruction of any aspect of the Sweepstakes, or loss, miscount, misdirection, inaccessibility or unavailability of an email account used in connection with the Sweepstakes. Sponsor is not responsible for any typographical errors in the announcement of prizes or these Official Rules, or any inaccurate or incorrect data contained on the Web Site. Use of Web Site is at user’s own risk. Sponsor and Promotion Parties are not responsible for any personal injury or property damage or losses of any kind which may be sustained to user's or any other person's computer equipment resulting from participation in the Sweepstakes. In the event of an identity dispute, Entry will be considered made by the registered owner of the email address used for Entry. “Registered owner” is defined as the natural person who is assigned an e-mail address by an Internet access provider, online service provider or other organization which is responsible for assigning email addresses or the domain associated with the submitted email address. All entries become the sole property of the Sponsor, and will not be acknowledged or returned.

If for any reason, Sponsor believes the Sweepstakes is not capable of running as planned, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify or suspend the Sweepstakes and/or proceed with the Sweepstakes, including the selection of the winner in a manner it deems random, fair and reasonable. Notice of such cancelation, termination, or modification of the Sweepstakes shall be posted at https://www.tostitos.com/NFLDRAFTRULES. This Sweepstakes is subject to all federal, state, and local laws and regulations.

By participating in the Sweepstakes, entrants release Sponsor, Promotion Parties, and NFL Entities (as defined below) from any and all claims, damages or liabilities arising from or relating to such entrant's participation in the Sweepstakes. By accepting a prize, recipients (and recipient’s parent or legal guardian if recipient is a minor) (a) agree that the Sponsor, Promotion Parties, NFL Entities (defined below), and all of their respective officers, directors, employees, representatives and agents will have no liability whatsoever for, and shall be held harmless by winner against, any liability for injuries, losses or damages of any kind to persons or property resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes; from acceptance, possession, misuse or use of prize and (b) grant (and agree to confirm grant in writing promptly upon request) to Sponsor and those acting under Sponsor’s authority the right to the use of his/her name, photograph, likeness, voice, image, statements and biographical information, at any time or times, for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, including the Internet without review, notification or approval, and additional compensation, unless prohibited by law. Sponsor is not liable in the event that any portion of the Sweepstakes is canceled due to weather, fire, strike, acts of war or terrorism, or any other condition beyond their control (a “Force Majeure Event”).

TAX LIABILITY: Winners are solely responsible for any federal, state, and local taxes on prize.
GENERAL CONDITIONS:No cash equivalent or substitution of prize is offered, except at the sole discretion of the Sponsor. No transfer of prize is permitted. Unclaimed prizes will not be awarded. If a prize, or any portion thereof, cannot be awarded for any reason, Sponsor reserves the right to substitute prize with another prize of equal or greater value. If for any reason the Sweepstakes is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right, at its sole discretion, to disqualify any individual who is responsible or who tampers with the entry process, and to cancel, modify or terminate the Sweepstakes. In the event of cancellation, Sponsor will randomly award the prize among all eligible, non-suspect entries received prior to cancellation. This Sweepstakes is governed by the laws of the state of Texas, and all claims must be resolved in the federal or state courts located in Collin or Dallas counties, Texas.

Sponsor will collect personal data about entrants in accordance with its Privacy Policy. Please review the Privacy Policy located at http://www.fritolay.com/legal/privacy-policy.htm for details of Sponsor’s policy regarding the use of personal information collected in connection with this Sweepstakes.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.

WINNER NOTIFICATION: Potential winners are subject to verification of eligibility and compliance with these Official Rules. Potential winners will be notified by Sponsor or Sponsor’s agency via Facebook direct message. Potential winners must have a public profile on their Facebook account used to enter in order to receive the notification or prize will be forfeited. Sponsor or Sponsor’s agency will request potential winner’s contact information (including email address, phone number, mailing address and date of birth). Sponsor is not responsible for any change in entrant's Facebook account and email address, mailing address and/or telephone number (after he/she has provided such information). Potential winners must provide the requested information within eight (8) hours or prize may be forfeited and awarded to an alternate winner (time permitting). Upon timely receipt of contact information, potential Grand Prize winner will be contacted by Sponsor’s agency via phone call and/or email. Upon verbal acceptance of Grand Prize, the potential Grand Prize winner may be required to complete, sign and return an Affidavit of Eligibility/Liability Release, and, where lawful, a Publicity Release before awarding of the prize. Grand Prize winners’ guest must be 18 years of age or older and may also be required to complete, sign and return a Liability Release (and where lawful, a Publicity Release) before awarding Grand Prize winner’s prize.

If the potential winner is found to be ineligible, is not in compliance with these Official Rules, declines to accept the prize, or the winner notification is returned as undeliverable or the potential winner fails to respond to a winner notification within the timeframe specified in such winner notification, or if the potential winner does not answer the initial notification, the prize may be forfeited and awarded to an alternate winner (time permitting). If the prize is forfeited for any reason, Sponsor may, at the Sponsor’s sole and absolute discretion, select an alternate potential winner at random from among the remaining pool of eligible entries received during the Sweepstakes Period, time permitting. If, after a good-faith attempt, Sponsor is unable to award or deliver a prize, that prize may not be re-awarded. Additional prize details and instructions on how to obtain prize tickets shall be provided to the Grand Prize winner after he/she has been verified as the official Grand Prize winner.
